In New York State, drivers are required to have a commercial driver's license (CDL) if they want to: (a) operate vehicles with a gross vehicle weight rating (GVWR) of 26,001 lbs. or more; (b) use trailers with a GVWR of more than 10,000 lbs. or where the gross combination weight rating is 26,001 or more; (c) drive vehicles designed to transport 15 or more passengers (not including the driver); and (d) operate vehicles used to transport hazardous material or where Homeland Security requires a background check and fingerprinting for a hazardous materials endorsement
CDL drivers are subject to various restrictions, and violations can mean suspension or revocation of the commercial driver's license and other penalties like jail time (if criminal).

Violations That Lead to CDL Suspension in New York |
There are a number of moving violations that can result in CDL suspension, for example:
- Speeding at 15 mph over the limit or more
- Unsafe or illegal lane change
- Tailgating
- Violations of New York Transportation Law / Regulations (weight, size and emissions)
- Leaving the scene of an accident
- Blood alcohol content (BAC) more than .04 percent
- Refusing to take a breathalyzer alcohol test
- Reckless driving
- Operating a commercial vehicle without the proper CDL
- Being the cause of an accident that leads to a fatality
- Running a red light
- Stop sign or yield violations.
A commercial driver's license will be suspended for 60 days upon conviction of two or more serious traffic violations within a three-year period. If the driver is convicted of three or more violations, the suspension is extended to 120 days.
