Reasons For Driver's License Suspensions in NY

Suspension of a New York driver's license (by DMV) can result from a number of things. The same is true for a suspended New Jersey driver's license, or even a suspended CDL (Commercial Driver's License).
 
Possible reasons for suspension or revocation of a driver's license are:
  • Driving with a Suspended License – VTL 511
    In New York, this offense is named Aggravated Unlicensed Operation (AUO). Your first offense is called AUO 3rd Degree and is a misdemeanor (crime) punishable by a maximum fine of $500 and up to 30 days in jail.  A second offense within 18 months is a misdemeanor called AUO 2nd Degree and carries a maximum fine of $1000 and up to 180 days in jail. 
  • Numerous Moving Violations
    In New York every moving violation comes with points on your driving record. Even the most minor moving violation carries 2 points. If you get 11 or more points within 18 months, the DMV will either suspend or revoke your New York driver’s license.
  • Driving without Insurance - VTL 319
    All cars in New York must be properly insured. A conviction for driving without insurance can also lead to driver’s license suspension.
  • Driving While Ability Impaired (DWAI) - VTL 1192-5
    If you are convicted of by Driving While Ability Impaired (DWAI) your will get a 90-day suspension. DWAI normally is given to people who are driving under the influence of drugs. If this your second DWAI charge within 5 years you will get a six month suspension.
  • Driving Under the Influence (DUI)
    If you are found guilty of driving under the influence (DUI) of alcohol your New York driving privileges will be suspended. The length of the suspension depends on your Blood Alcohol Content (BAC) and whether this is your first or repeat offense. If your blood alcohol content (BAC) measures over 0.18% you will be charged with Aggravated Driving While Intoxicated and your NY driving license will be suspended for one year. If your blood alcohol content (BAC) measures under 0.08% you will be charged with Driving While Intoxicated (DWI). If convicted of DWI your driver’s license will be suspended for six month.

    Your New York drivers License many also be suspended if you are found guilty of:

    If you are convicted of a serious traffic violation with a Junior License or any other 2 violations, your license will be suspended for 60 days.  
  • Speed contest
    If convicted of conducting a speed contest your license will be suspended for six months.

  • False Information
    If convicted of, the criminal charge, of giving false information on to a DMV employee or using another person for a New York road test. Your license will be suspended for 6 months or more.
